Design Patent - Infrigement



A  registered design constitutes an injunctive relief for the owner to prevent others from using the design. This injunctive relief may either be claimed out of court (e.g. by a warning letter) or by suing the respective party (e.g. by infringement suit before the ordinary courts or by temporary injunction).

 

We determine whether a design infringement is existent and initiate the necessary steps, e.g. the preparation of a warning letter or the filing of a request for temporary injunction, for example if a design is infringed at a fair.
