A patent is granted, if a respective application is filed and the examination procedure, which has to be initiated separately (with costs) by filing a request for examination, is completed with a decision of grant. During the examination procedure the German Patent and Trademark Office decides whether the application meets all the formal requirements, whether the claimed invention is new and is based on a creative idea and whether it complies with other legal requirements.
A patent, however, may also be affected after being granted, e.g. by opposition in due form, i.e. during the term for filing opposition of 3 months after the publication of the grant of a patent, or by action for declaration of nullity.

We prepare all necessary documents (patent claims, patent description, drawings) and file them with the German Patent and Trademark Office. We also take over representation of this patent application and duly remind you of all necessary steps to be taken.
Both during the granting procedure and the opposition or nullity procedure we defend the patent and the application respectively against the opposing party.
