Trademark - Application and Registration



A trademark is registered by the Patent and Trademark Office on application. During the registration procedure the trademark is checked for absolute impediments to protection. For example, the office checks whether the trademark has enough distinctiveness, for example if it is imaginative. It is important to recognize that the German Patent and Trademark Office does not conduct research on prior rights that might be potentially subject to confusion. The granting procedure may be expedited by a separate request being filed for the proceedings to be accelerated and this is subject to fee.

After the publication of the trademark registration other trademark owners are able to file an opposition against the trademark registration within a term of  three months.

We prepare the necessary documents (index of the goods and services to be protected) and file these with the German Patent and Trademark Office. We take over representation of this trademark application and duly remind you of all necessary steps to be taken.

Both during the granting procedure and the opposition procedure we defend the trademark against the opposing party.
