Trademark - Opposing Rights of Others



In order to be capable of attacking trademark rights and rights to a name of others, the actual use of the own trademark is absolutely necessary. The own prior right is very important for attacking. The attack may either be based upon the trademark itself or the company name or the internet domain.

Moreover, there is the possibility of attacking the trademark of the opposing party on grounds of non-use.
