Utility Model - Application and Registration

The Patent Office only checks the formality of the utility model application. It does not consider the matter. Especially, it does not check the capability of being protected in the case of a utility model application. As the utility model unfolds its protective effects at the time of the registration, it is a protective right which is quickly available, the registration process of which being only a few months. The utility model may be attacked by others with a request for cancellation. The opposing party might argue that it is not possible to protect the protected item, for example as the respective item had been an exhibit at a fair two years prior to the day of application.

Upon request (with cost) the German Patent and Trademark Office prepares a research report on the novelty of the invention claimed by the utility model.
We prepare all necessary documents (protection claims, description, drawings) and file them with the German Patent and Trademark Office. We also take over representation of this utility model application and duly remind you of all necessary steps to be taken.
If the utility model is being attacked by request for cancellation, we defend the utility model against the opposing party.
