Marketing, Name and Domain Law

Marketing, Name and Domain Law - Spectrum of Services Advertising messages like “organic” or “healthy” are not insertable by implication. The legislator has passed regulations in various cases in order to protect the consumer.

We check advertising messages, for example in brochures or in the internet, for their conformity with marketing law issues.

Name law, the right to a firm as well as the right to an internet domain, is very similar to trademark law. By using a special firm name or a special internet address the trademark law of another person might be infringed.

We consult and represent in cases of the collision of names.

Furthermore, we search for prior names and domain rights.

We determine whether an infringement is existent and initiate the necessary steps, e.g. the preparation of a warning letter or the filing of a request for temporary injunction, for example if a trademark is infringed at a fair.
